Two persons, Nze Dozie Nweke, the President-general of Aboji Akanano, Oba in Idemili Local Government Area of Anambra State and Anugo Onunkwo were Monday issued with warrant of arrest by an Anambra State High Court sitting in Ogidi, headquarters of the Local Government.
The presiding Judge, Justice Chudi Nwankwo, of Ogidi High Court 11, issued the warrant of arrest when the case came up for hearing and the defendants were not in the Court.
But counsel to Nweke, Mr. Vitalis Jimeh, expressed shock that the case came up Monday without the knowledge of his client and himself.
He said they have filed a written application on the matter, Suit/HID)1C/2019 for bail for his client, which they served the office of DPP but no date for the matter was fixed.
He said it was the prerogative of the prosecution to choose a date for the hearing in the matter.
Unfortunately, said Jimeh, they were waiting for the date to be communicated them, only to hear that the matter came up on Monday, Judy 8, 2019 and one Mr. Obinna appeared Nweke's counsel and one other defendant, Onukwo, while G.C Agboro appeared for the prosecution.
Jimeh said his client has emphatically told him that he did not brief any other lawyer, neither was he informed of the Monday's proceedings even when he had called Agboro.
However when he (Jimeh) called Agboro when they got the information after the proceeding had taken place, Agboro said his senior in the DPP office,one Ikenna, called him Sunday night directing him to come to the matter on Monday but he failed to inform him of the proceeding that Sunday night.
One Obinna, said Jimeh, appeared for his client even when there was no application for a change of counsel.
He said it was at the proceeding that his client was issued with a bench warrant even when they were not informed of the proceeding.
Jimeh said the normal practice was that if another lawyer wants to take over any case, the lawyer has to formally apply which he doubted happened in this instance.
"Our motion for bail is still pending in the High Court 11, Ogidi. Who then brought the Lawyer that stood for my client. That we will find out when we go to Court"said Nweke's Lawyer.
He said on Tuesday, July 9, 2019, he will file a motion to tell the Court all that.
The presiding judge adjourned the case to July 17th, 2019.
