The community said the Anambra State Government under Dr. Chinwoke Mbadinuju had in 2002 taken over the land to build an international market in partnership with a private developer, Burkham Nigeria Limited with a firm promise to pay compensation to the owners.
Burkham has however ceded the right to Micpan company to develop the land, hence they are now selling of part the land to aluminum traders.
But the chairman of Ezegbe kindred of Oba said that there is no way the companies can enter their land to sell it to people without paying them compensation.
Speaking to the media after their protest against the alleged take over, the chairman of Ezegbe, Pastor Ben Anajemba, lamented that inspite of their letters to the Anambra State Governor to intervene in the land grab, nothing has been done about it.
He said the Supreme Court judgment which the officials of Burkham and Micpan we're relying on to take over their land has been declared a nullity by the Consent Judgment which they had.
The judgment stipulated that the Ogwugwu people obtained that the Supreme Court Judgment by fraudulent means because the evidence they tendered at the Court was fraud.
"They confessed to that in a document which led to the consent judgment, although they went back, refused the consent judgment and went to Court but it was struck out" said Pastor Ben.
He said inspite of the fact that they have dragged the Anambra State Government, Burkham, the Nigerian Police and others to Court, Micpan in concert with Burkham still used soldiers, Police and thugs to take possession of the their ancestral land to build illegal structure.
But he vowed that they cannot take their ancestral land without appropriate compensation to the owners
He warned that the land with a survey plan number UMAX AN 09/19 being the Umuezegbe- Aboji ancestral Land, Oba, Idemili Local Government Area, which wrongful acquisition is a subject of litigation in a Suit No HO/M I SC 33/2018, between Evangelist Ben Anajemba and 50 others versus the Governor of Anambra State and 18 others in Idemili High Court is not for sale.
He said the Umuezegbe, the ancestral owners of the land is not selling the land and any person negotiating or transacting business with Burkham Nigeria limited or any other person or group of persons with respect to the land is doing so at his or her own risk.
He said this warning has become necessary because Micpan and Burkham have given their land to private developers, aluminum traders, thereby ,"depriving us our fundamental rights of ownership of our ancestral land, without compensation.
Continuing he said "since they want to kill us with soldiers, Police and thugs, the world will hear our voice. This is clear act of imtimidation to take over what belongs to another person".
