Businessman Drags IG, CP To Court...Demands N5m Damages

An Onitsha businessman, Chief Samson Umejidike Ifedibia, has dragged the Inspector-General of Police (IG) and five others including the Anambra State Police Commissioner, Mr.Mustapha Dauda Uhra to court for infringing on his fundamental human rights.

Other Police Officers involved in the suit are the Assistant Inspector- General of Police (AIG), Zone 9, Umuahia, Assistant Commissioner of Police (ACP), in charge of the Criminal Investigation Department (CID), Lagos, Anthony Onyia, and Ikechukwu Umeaku, business men at Bridgehead, Onitsha, Anambra State.


In the suit which number is 0/misc. 143/2019  filed  at Anambra Court sitting in Onitsha, Umejidike had asked the Court to declare that the attempt to arrest and detain him, exhort huge sums of money from him as "bail fees' as well as humiliate him before the members of the general public by the Police based on a purely civil matter which was the illegal importation of "STIHL" machine parts  was unlawful and a violation of his fundamental rights to liberty guaranteed in 1999 Constitution as amended.

In the suit filed by his counsel, Chibuike Nwabueze, the applicant also demanded that the Court  should declare the inasion of his home at Isioji Village Ezinifite town, Aguata Local Government Area of Anambra State on April 22, 2019, and the arrest of three Police men from Special Protection  Unit (SPU), base 8, Lokoja, Kogi State  attached to him and the other to withdraw them from him by Daura and the Police from Panti, Yaba,  Lagos State violates the applicant's fundamental rights.

The applicant among other reliefs demanded the payment of five million naira as exemplary damage against the respondents, jointly and severally for the unlawful violation of his rights to liberty, association and others as guranteed in the 1999 Constitution as amended.

When the applicant's counsel made an exparte application for substituted service, Justice Sylvester Odili ordered that the respondents be served with Court processes and other documents.

He adjourned the case to June 5, 2019, for report of service and hearing.
