Ogboru Vs Uduaghan: S-Court sets June 21 for ruling


ABUJA, The Supreme Court, Monday, adjourned till June 21 to deliver ruling on a fresh application seeking to sack Governor Emmanuel Uduaghan of Delta State from office.

The application, which was entered by the governorship candidate of the Democratic Peoples party, DPP, in the April 26, 2011, gubernatorial election in the state, Chief Great Ogboru, is seeking to resurrect the verdict of the apex court that declared the appellate court judgment that affirmed Uduaghan̢۪s election as a nullity.

Briefing beneficiaries, the Democratic Peoples Part (DPP) Delta Central chairman, Chief Henry Olori said the exercise is in continuation of the Senator’s empowerment scheme in fulfillment of his electioneering promises to the electorate. According to Chief Olori, as against the current 21 cars being given out in the first batch, the extra, making it a total of 35, would be given out in the second batch. In his reaction, a chieftain of Democratic Peoples Party (DPP), Mr. Igoruh Onobaka, lambasted the Senator, saying he promised to install factories in some cities in Delta central, now he is given out cars instead of the factories he promised during election. It should be noted that these type of cars cannot even be used for commercial purposes. While we regard this as a stark rape on our fragile democracy, we wish to call on Deltans especially Delta Central (the Urhobos), to be wary of politicians who use money meant for the development of their communities to buy cars for their political aids.

COURT DECLARES DELTA LAWMAKER’S SEAT VACANT FOR DECAMPING

IN what can be described as a watershed judgment, a Federal High Court sitting in Asaba, Delta State has ordered the Speaker of the Delta State House of Assembly, Chief Victor Ochei to declare the Ukwani Constituency presently being occupied by Dr. Alphonsus Ojo vacant. Ojo’s offence was that he decamped on September 28 last year from the opposition Democratic People’s Party (DPP), under whose ticket he was elected in the April 2011 election, to the ruling People’s Democratic Party (PDP). Irked by the betrayal, in suit No. FAC/ASB/CS/129/12, the DPP and one Mr. Chukwuma Dafiakpaku had dragged the House, Ochei, Ojo and the Independent National Electoral Commission (INEC) to court, demanding that the lawmaker’s seat be declared vacant in line with Section 109 of the 1999 Constitution. In her judgment, which lasted about 10 minutes, Justice CMA Olatoregun-Ishola ruled that the Speaker must compel the embattled lawmaker to vacate his seat, as his decampment was not in order. Quoting copiously from the Constitution, Justice Olatoregun-Ishola disagreed with Ojo, who, among other reasons, said that he left the party for the PDP as a result of serious internal crisis and factionalism, which was tearing the party apart. According to her, Section 109 (g) of the Constitution unambiguously stated that: “A member of a House of Assembly shall vacate his seat in the House, if being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period, which the House was elected; provided that his membership of the political party is not as a result of division of the party of which he was previously a member or a merger of two or more political parties or factions by one of which he was previously sponsored.” She said that even if there was a crisis in the DPP, it has not in any way led to the break-up of the party, as it was still in existence with neither a faction nor a splinter group. The presiding Judge said: “The third defendant is caught by the extant provision of Section 109 of the Constitution. I am under the mandatory obligation to declare his seat vacant. Consequently the seat of the Ukwani Constituency has been declared vacant. The Speaker has been ordered to declare the seat vacant. INEC should conduct another election.” In his reaction to the Judgment he said, ”I give all glory to God Almighty, I still remain a member of the House as a stay of execution of Judgment has been filed. I will still deliver on my promises of good governance and development/accountability to Ukwuani.” He said.

2011 Asaba Airport Recruitment Remains Inconclusive. List of Successful candidates with Austin Ayemidejor

It was revealed yesterday, about one year and seven months after the conduct of Asaba Airport recruitment test that Governor
Uduaghan refused the list of successful candidate and the list has since been with the State tender board Chairman and Airport Director, Mr Austin Ayemidejor.
The recruitment test took place in all the local council areas on 20th August 2011 under the supervision of Ayemidejor.

The reason for the Governors refusal to accept the list of successful candidate according to one of Ayemidejor’s aide, is due
to the Governor’s fear of paying salaries maintaining that the Airport has not fully kicked off and Do not generate revenue at the moment.

The aide craved anonymity for fear of being sacked. He further maintained that it is not certain whether the list with his boss will still be used if the Governor takes a decision on the recruitment as it has stayed longer than necessary with his boss.

As applicants wait patiently, the recruitment is still underway as maintained by the Government, and to Deltans it remains inconclusive.
